The end of the EULA and shrinkwrap licensing

The catch with software purchases is that retailers/resellers will not let you return them if the package has been opened. However, if you disagree with the EULA (End Users Licensing Agreement) you are directed by that same EULA to return the product. Which you can’t access without opening the package.

This was recently tried in California court and overturned. Not that since California is the largest software consumer market, what happens there tends to spill over to other states.
